In diesem Mustervertrag werden insbesondere die zu erbringende Leistung des Vermittlers und die Modalitäten der Zahlung der Provision geregelt (Vermittlervertrag). Zudem sind ausführliche Bestimmungen darüber vorgesehen, wann, unter welchen Voraussetzungen und in welcher Höhe (beispielsweise gemessen am vermittelten Umsatz etc.) die Provision anfällt und unter welchen Umständen sie ggf. wieder entfallen kann (beispielsweise der vermittelte Kunde zahlt nicht an den Vermittlungsleistungsempfänger).

The following model contract for an independent contractor agreement is usable for any situation in which somebody offers contractual services for another person and receives remuneration for this.

This model contract describes precisely the services that have to be offered as well as the details of the payment. In order to avoid legal uncertainty, this model contract has detailed clauses about the time, the extent and the conditions under which remuneration has to be granted  (for example depending on the business volume generated by the contractor) as well as conditions under which the remuneration can be denied (for example if the customer does not fulfil his obligations).
